Simple Putting in Possession

This is the most common succession procedure. We gather documents and information from you to prepare the required pleadings and documents, which are then filed with the court and reviewed by a judge. Once approved, a Judgment of Possession is rendered, establishing heirs and facilitating the transfer of assets.

  • One Decedent: $2,500
  • Two Decedents: $3,500

This process is ideal when:

  • The decedent lived in Louisiana and had no assets outside of the state;
  • The will (if any) is valid and uncontested;
  • All heirs or legatees are known, cooperative, and can be located;
  • No minors or interdicted heirs are involved;
  • The estate has no significant debts or creditor claims;
  • The property can be easily described and does not require title research;
  • There is no need for administration, inventory, or accounting.

These flat fees include:

  • A consultation with an attorney;
  • Review of estate documents;
  • Communication with the court and the clerk’s office;
  • Preparation and filing of all pleadings and documents, including but not limited to: Parent
  • The Petition for Possession
  • The Affidavit of Death, Domicile, and Heirship
  • The Sworn Detailed Descriptive List;
  • The Judgment of Possession.

These flat fees do not include extraordinary services such as:

  • Locating missing heirs or legatees;
  • Locating assets and liabilities;
  • Title work for immovable property;
  • Handling estate debts and creditor claims;
  • Filing estate tax returns.

Succession Under Administration

For more complex situations, such as the extraordinary services outlined above, a succession under administration is required. A succession under administration involves multiple stages, including probate and potential appointment of an executor or administrator.

Due to the complexity, we charge hourly rates for these cases:

  • Attorney: $250 per hour
  • Paralegal: $125 per hour
